By using the Website, you agree to these Terms & Conditions (the “Terms”). Please read them carefully before browsing or making any purchase.

1. General

This agreement becomes effective on the date any user first uses the Website and remains in force until the user stops using the services.
These Terms are written in masculine form for convenience only and apply equally to all genders.
Bens Jewelry (the “Business”) owns and operates bensparis.com (the “Website”).
Use of the Website and its content is subject to these Terms.
Each user declares that they have read, understood, and agree to the Terms in full. Browsing and using the Website constitute full acceptance.
Use of the Website is permitted for lawful purposes only, by legally competent individuals or corporations.
Users acknowledge they will have no claims against the Business in relation to the provisions of these Terms.

2. Website Availability & Changes

The Website is generally available 24/7; however, it may be unavailable due to outages, maintenance, or other reasons.
The Business may suspend your use of the Website if you breach these Terms.
The Business may update the Terms at any time at its sole discretion without prior notice. The binding version is the one published on the Website at the time of use.
Third‑party content or advertising on the Website does not constitute a recommendation or endorsement by the Business.
If you do not agree to the Terms (in whole or in part), you may not use the Website for any purpose.

3. Termination

The Business may terminate this agreement at any time if: (a) you breach the Terms; (b) required by law; or (c) continued service is not economically feasible. Where possible, reasonable prior notice will be provided.
The Business may change or discontinue the services (in whole or in part) without prior notice and shall not be liable for any resulting loss or damage.
Provisions regarding intellectual property and disclaimers shall survive termination.
From time to time, information on the Website may contain typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, availability). The Business reserves the right to correct or update information or cancel orders if any information is inaccurate, at any time and without prior notice (including after an order is submitted).

4. Data Security & Privacy

The Business operates in accordance with applicable law, including the Israeli Privacy Protection Law. Information provided by users will not be transferred to third parties, except as permitted by law.
Credit card data transmission is secured.
User details are used solely for operating the Website and processing orders.
Despite robust measures, absolute protection against intrusion cannot be guaranteed. By agreeing to these Terms, you waive claims arising from such events.
Upon registration, you may be asked to create a username and password and provide contact details. You are solely responsible for maintaining their confidentiality and keeping them up to date.
All activity performed through your login credentials is your responsibility. The Business is not liable for activity in a user account by anyone using those credentials.
The Website employs advanced security measures. You agree not to engage in any activity that could disrupt the Website (including, without limitation, data theft or security breaches). The Business may block access and take legal action against such activity.
The Website may include links to third‑party sites. The Business is not responsible for their availability, accuracy, or content and is not liable for any damage arising from their use.

5. User & Visitor Management

The Website management may block any user (e.g., by IP) without prior notice or explanation.
While the Business endeavors to protect user data, if a third party gains access to stored information, the user will have no claim unless a final court judgment determines the Business caused the loss intentionally.
The Business may store customer details and use them for direct marketing via SMS and/or email unless the customer opts out.
Users can change their marketing preferences at any time in their account settings.
The Business may run promotions, issue coupons, discounts, or other benefits and may end them at any time. No double‑discounts. Benefits are personal and non‑transferable.

6. Disclosure

This Website may use cookies (especially for registered users/subscribers) and internal analytics tools to maintain anonymous statistics and analyze traffic, clicks, and time on site.

7. Product Purchases

Purchases are made by credit card only or by cash payment upon self‑pickup.
During checkout you must provide personal details (ID number, phone, email, billing/shipping addresses, and payment details). Payment and personal data will be used solely to complete the purchase.
Order confirmation does not bind the Business; it may cancel any order or confirmation at its sole discretion without prior notice or explanation.
Approval of an order is subject to the item being in stock (with the Business or supplier). If out of stock, the Business will notify you and either refund amounts paid or cancel the charge. A substitute product may be offered.
Some products may be supplied by third parties; delays due to such parties shall not give rise to claims against the Business.
The Business may at any time stop selling certain products, add new products, or change the assortment.
Prices shown generally include VAT unless stated otherwise. Prices may change at any time; the price applicable is that at order approval.
Despite efforts to ensure accuracy, unintentional errors in descriptions or images may occur. Product photos are for illustration only unless otherwise stated on the product page.
Wholesale purchases are not permitted via the Website without prior written approval. The Business may decide what constitutes a wholesale order and refuse such orders.
Customized products: the Business may refuse custom orders that include shapes/text deemed offensive or inappropriate. Custom items cannot be returned or canceled; please verify sizes and engraving details before ordering.
Prices on the Website may differ from other channels (e.g., social pages or physical stores). Website prices govern online purchases.
Gemological certificate: available for an additional NIS 100, payable in advance.

8. Orders, Payments & Shipping

The Business may change payment methods and ordering flows at any time.
Delivery may be via courier to the address provided at checkout (subject to shipping areas shown on the Website) or via self‑pickup in Business stores.
Shipping methods/areas may change from time to time.
Shipping fees are charged in addition to order total and may be updated from time to time. Taxes, import duties, or customs fees (if any) are borne by the customer.
Courier services are provided by third parties; the Business is not responsible for damage caused by such providers. Delays beyond the Business’s control (force majeure, security situations, extreme weather, natural events, roadblocks, strikes, etc.) do not release the customer from payment obligations.
If the courier cannot locate you at the scheduled time despite prior coordination, delivery will not be completed; you must coordinate a new time and may be charged for an additional delivery.
At the courier’s discretion and with your consent, a parcel may be left at a location where you are not present (e.g., at your door or with an authorized person). If you consent, you accept full responsibility for loss, theft, damage, or non‑conformity.
Packaging is determined at the Business’s discretion.
Delivery fees may vary by product and destination based on weight and location and are determined at the Business’s sole discretion or by the courier company.
Note Shipping costs are collected by the Business for the courier company. Shipping is not included in any subscription fees (if applicable).

9. Cancellation & Returns (Sales)

Returns and cancellations are subject to the Israeli Consumer Protection Law, 1981.
Items that have been used or custom‑made to order cannot be returned, except for defective products in accordance with applicable law (including the Defective Products Liability Law, 1980).
Special‑order jewelry (including pieces made to customer’s measurements or with diamonds selected by the customer) are non‑returnable.
Order changes or cancellations are subject to the Business’s discretion. Upon cancellation, refunds may be subject to a cancellation fee of up to 5% of the order value or NIS 100 (whichever is lower).
If you add products when changing an order, the added items will be charged at the price effective on the change date.
You may cancel a transaction within 48 hours of receiving the order (unless the product is non‑returnable by law). After timely notice of cancellation, the Business will coordinate the return method. Return shipping is the customer’s responsibility.
After the returned item is received and inspected and found in acceptable condition, a refund will be issued within up to 14 business days. Cancellation fees may include shipping costs, if any.
Upon receipt, you must check that the items match your order (e.g., quantities). Any non‑conformity must be reported within 1 business day; otherwise, the order is deemed accepted.
For credit‑card cancellations, a 3% processing fee will be charged.
For jewelry purchases above NIS 3,000, the Business may, at its discretion, issue store credit or allow an exchange instead of a refund.

10. Website Content

Links to external sites do not constitute any commitment, guarantee, or assurance by the Business. Use is at the customer’s sole risk.
Product images are for illustration only and are not binding, unless expressly stated otherwise on a product page.

11. Intellectual Property

All jewelry designs displayed on the Website are the intellectual property of the Business and may not be used without prior written permission.
The Website and all materials therein—including design, code, graphics, photos, videos, texts, and any other media—are owned by the Business and protected by law.
You may not distribute, copy, imitate, reproduce, publish, or re‑process any code snippets, trademarks, videos, images, or other media without prior written approval.

12. Miscellaneous

These Terms (including the Privacy Policy) constitute the entire agreement between the parties and supersede any prior proposals or representations, written or oral, regarding the subject matter. Any change, amendment, or waiver is valid only if made in writing and signed or electronically approved by the party to be bound.
The governing law is exclusively the laws of the State of Israel.
Exclusive jurisdiction rests with the competent courts in Tel‑Aviv, Israel.
Users have no right of setoff against the Business and may not retain jewelry or any other property of the Business as a condition for refunds.
Indemnity: You agree to defend, indemnify, and hold harmless the Business and its predecessors, successors, affiliates, officers, directors, shareholders, investors, employees, agents, representatives, and attorneys from and against any loss, damage, cost, and expense (including reasonable attorneys’ fees) arising out of or related to: (a) gross negligence or willful misconduct; (b) your use of the services; (c) your data; (d) your breach of these Terms; or (e) your infringement of any third‑party intellectual‑property rights or violation of applicable law.
